1. Introduction
This document sets forth the Terms and Conditions (T&C) for participation in the Casumo Affiliates Program. This legal agreement is between Mediaology Limited, a company incorporated in Gibraltar with registration number 107628 and its registered address at Suite 5B, Watergardens, Block 1 GX11 1AA, Gibraltar (“Casumo,” “Company,” “us,” or “we”) and the Affiliate (“you”). By registering for and participating in the Casumo Affiliates Program, you agree to these T&C.
2. Acceptance of Terms
Your registration for and participation in the Casumo Affiliates Program signifies your understanding of, agreement with, and commitment to abide by these T&C.
3. Eligibility for Participation
To participate, you must be at least 18 years old or the legal age for gambling in your jurisdiction, whichever is higher, and operate a suitable platform for promoting Casumo.
4. Affiliate Obligations and Conduct
As an Affiliate, you agree to promote Casumo responsibly and ethically, adhering to all applicable laws and marketing guidelines. Misleading or inappropriate promotions are strictly prohibited.
5. Marketing and Promotional Activities
You must use approved marketing materials and adhere to guidelines provided by Casumo for advertising and promotions. Unauthorized or unethical marketing practices are not permitted.
6. Commission Structure and Payment
You will earn commissions based on a structured percentage of the Net Revenue generated from new depositing customers referred by you, as detailed in a later section. Payments are subject to meeting a minimum earnings threshold and are processed monthly.
7. Intellectual Property Rights
Casumo grants you a non-exclusive, non-transferable license to use our trademarks and promotional materials as specified in these T&C for the purpose of promoting our services.
8. Confidentiality
You are expected to maintain the confidentiality of all proprietary information and data shared during your participation in the program.
9. Term and Termination
This agreement is effective upon your acceptance and remains in effect until terminated by either party. Terms for termination, including specific conditions and procedures, are outlined within these T&C.
10. Modifications to Terms
Casumo reserves the right to modify these T&C at any time. You agree to be bound by any such modifications, which become effective upon posting on the program website or notification to you.
11. Governing Law
This agreement and any disputes arising from it are governed by the laws of Gibraltar. Both parties submit to the jurisdiction of the courts in Gibraltar for resolution of any disputes.
12. Commission Structures
- 0-5 New Depositing Customers (NDCs) per month: 25% of Net Revenue
- 6-10 NDCs per month: 30% of Net Revenue
- 11-20 NDCs per month: 35% of Net Revenue
- 21-40 NDCs per month: 40% of Net Revenue
- 41+ NDCs per month: 45% of Net Revenue
Net Revenue is calculated as the revenue generated from new customers referred by the Affiliate minus winnings, bonuses given, and other standard deductions.
13. Responsibilities and Obligations of the Affiliate
The Affiliate must use ethical and legal means to promote Casumo, following all applicable laws and marketing guidelines. The Affiliate is prohibited from using misleading or harmful advertising practices and is required to maintain accurate and truthful information about their promotional methods and website traffic.
14. Rights and Obligations of Casumo
Casumo retains the right to modify any aspect of the Affiliate program or its policies at its discretion and will provide the Affiliate with necessary marketing materials and support for effective promotion.
15. Legal Compliance and Indemnification
The Affiliate must adhere to all legal standards applicable in their jurisdiction and the jurisdictions they target. The Affiliate agrees to indemnify and hold Casumo harmless from any legal consequences or claims arising from their promotional activities.
16. Dispute Resolution
Any disputes arising under this agreement will first be attempted to be resolved amicably. Unresolved disputes shall be submitted to binding arbitration in accordance with the laws of Gibraltar.
17. General Provisions
This Agreement constitutes the entire agreement between the parties regarding the Affiliate Program. If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in effect.
18. Acknowledgment
By participating in the Casumo Affiliates Program, you acknowledge that you have read, understood, and agreed to all the terms and conditions outlined in this document.
